Consent kit

What to tell your clients.

Before you record a session, your client should know what is recorded, where it goes and how to say no. Here are the words: a short script, a paragraph for your consent form, a one-page handout, an opt-out line and what to do when someone says no. Copy them, change them, use them. No sign-up.

This kit is a starting point, not legal advice. Laws and licensing board rules differ by state and change often, and more states have bills pending. Check the rules where you and your client are, and change the wording to fit your practice. Updated October 19, 2026.

Before you start

The handout makes promises about your computer. Make them true first.

  1. Turn on disk encryption and a login password on the computer you record with. The device checklist on safeclip.io/no-baa walks through it.
  2. Keep cloud Ask off. In Settings, the pure-local lock removes it entirely. If you use cloud Ask, the client handout is no longer accurate.
  3. Decide when audio is deleted, and put it in the blanks. Safeclip can delete audio for you: Settings shows when, so make it match what you tell clients. You can also delete a recording yourself once the note is done.
  4. Fill in the blanks in square brackets, and check the wording against your licensing board’s rules and your state’s law.

Square brackets are blanks to fill in. Whatever you promise about deleting audio, check that Safeclip's settings match it. Device checklist →

What to say

About 30 seconds, at the first session, before you press record. Say it in your own words.

Before we start, I’d like to ask about recording. I use a program called Safeclip. It records our session and uses AI that runs on this computer to transcribe it and draft my notes. I read and correct every note myself, and the AI doesn’t make decisions about your care.

The recording and notes stay on this computer. They aren’t sent to Safeclip. [I delete the recording after I’ve written the note.]

You can say no, or ask me to stop at any time, today or later. Your care stays the same either way. Is it okay with you if I record today?

Written consent

For your intake or consent form. Keep it as its own section with its own signature or initials: Illinois, Maine and Colorado don't count a line buried in general terms.

Consent to record sessions with an AI note tool (Safeclip)

With your permission, [practice name] records therapy sessions with Safeclip, a program that runs on your therapist’s computer. Safeclip uses artificial intelligence for one purpose: to turn the recording into a written transcript and a draft summary that helps your therapist write session notes. Your therapist reviews and edits every note. The program does not make decisions about your care, does not talk with you, and does not create treatment plans.

The recording, transcript and draft are created and stored on your therapist’s computer, which is protected by a password and encryption. They are not sent to Safeclip, the company that makes the program, and they are not used to train AI models. The audio is deleted [after the note is written / within __ days]. The final note becomes part of your clinical record and is kept [for __ years / as the law requires]. When therapy ends, [any audio still on the computer is deleted, and your record is kept as described above].

You can say no. You can withdraw your consent at any time by telling your therapist or writing to [contact]; recording stops from then on. Saying no or withdrawing does not affect your care.

  • I agree to have my sessions recorded and transcribed with Safeclip, as described above.
  • I do not agree. Please do not record my sessions.

Recording our sessions: what happens to it

I’d like to record our sessions and use an AI tool to help me write my notes. Here is what that means, in plain words. Nothing is recorded unless you agree.

What is recorded
The sound of our session, through a microphone on my computer [or the audio of our video call]. No video.
What the AI does
A program called Safeclip uses AI that runs on my computer to turn the audio into text and draft a short summary. I read it, correct it and write the final note myself. The AI doesn’t decide anything about your care.
Where it stays
On my computer, which is protected by a password and encryption. The recording, the text and the draft are not sent to Safeclip, the company that makes the program, or to any other company.
Used to train AI?
No. The company doesn’t receive your recording, and the program on my computer doesn’t learn from it.
How long it is kept
I delete the audio [after I write the note / within __ days]. The written note becomes part of your record and is kept [for __ years / as the law requires].
When therapy ends
[Any audio still on my computer is deleted. Your record is kept as described above.]
Your choices
You can say no. You can say yes now and change your mind later. You can ask me to stop recording at any time, or to delete a recording before I’ve written the note. Your care stays the same whatever you choose.

Questions? Ask me any time. [Your name, contact]

The opt-out line

Say it every time you ask, and put it on anything you hand over.

You can say no to recording, or ask me to stop at any time, now or later. Your care won’t change either way.

If the client says no

Some clients will. It shouldn't cost them anything, and in Maine and Colorado you can't refuse treatment because of it.

“That’s completely fine. I won’t record. I’ll write my notes myself, the way I always have.”

  • Don’t record. Write the note the way you did before. You don’t need Safeclip for it.
  • After the client leaves, dictate a short voice note of your own summary, or type it into a blank note. The client isn’t recorded, and Safeclip transcribes your summary on your computer.
  • Dictating a summary still runs session details through AI on your computer. If the client said no to AI altogether, not only to recording, write the note without Safeclip.

States that require consent for AI in therapy

We read each of these in the enacted text. Others have bills pending, and boards add their own rules, so treat this as a floor, not a full list.

  • Illinois

Wellness and Oversight for Psychological Resources Act, Public Act 104-0054. In effect since August 1, 2025.

If AI helps with a session that is recorded or transcribed, the client must be told in writing that AI will be used and for what purpose, and must consent. Consent has to be a specific written agreement the client can revoke; accepting general terms of use doesn’t count.

  • Maine

    Public Law 2026, chapter 687 (LD 2082). Signed April 13, 2026.

The written notice must also say how session data is stored, retained, used for training and deleted when therapy ends. Consent can be given by initialing a specific section of the consent-to-treatment form. A clinician may not refuse treatment because a client declines.

  • Colorado

    HB26-1195. Signed June 3, 2026; in effect from August 12, 2026.

Before AI records or transcribes a session, the client must be told in writing, in advance, that AI will be used and why, and must consent in writing. Refusing or withdrawing can’t be a reason to deny services. Consent is needed once, unless the purpose or the way you use it changes.

This kit is a starting point, not legal advice. Laws and licensing board rules differ by state and change often, and more states have bills pending. Check the rules where you and your client are, and change the wording to fit your practice.

In Safeclip

  • With the therapy setup, Safeclip shows a consent reminder on screen while you record, and on the prompt when it spots a meeting. You can turn it on in Settings for any setup. It is a reminder, not a consent form.
  • Safeclip can delete the audio for you; Settings shows when, so you can make it match your handout. You can also delete a recording yourself once the note is done. Transcripts and notes stay.
  • Safeclip doesn't join calls as a bot, so nobody is told automatically. Asking is up to you.
